Welcome to NextEyeExam. These Terms of Service ("Terms") govern your access to and use of the NextEyeExam website, platform, and services (collectively, the "Service"). Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
NextEyeExam acts strictly as a booking facilitator and marketing platform connecting patients with independent optometry clinics. We are not a healthcare provider. We do not provide medical advice, diagnosis, or treatment. Your relationship regarding medical care is solely between you and the independent clinic you select.
2. Eligibility for Rewards
NextEyeExam offers promotional rewards (e.g., a $50 digital gift card) to eligible patients who book and complete a comprehensive eye exam through our Service. To be eligible, you must:
- Be at least 19 years of age and a resident of British Columbia.
- Initiate the booking request exclusively through NextEyeExam.com.
- Be a new patient to the specific clinic selected (no visits in the prior 36 months).
- Attend the appointment and pay for a comprehensive eye exam in full.
- Upload a valid, itemized receipt to the Service within thirty (30) days of the appointment date.
Government Coverage Exclusions: Pursuant to provincial healthcare regulations, examinations fully or partially covered by the British Columbia Medical Services Plan (MSP) are strictly ineligible for promotional rewards.
3. Fraud and Account Termination
We reserve the right to withhold rewards, cancel pending appointments, and permanently ban users from the Service if we suspect fraudulent activity. Fraudulent activity includes, but is not limited to:
- Submitting altered, forged, or fake receipts.
- Creating multiple accounts to bypass the lifetime reward limit.
- Canceling credit card payments with the partner clinic after receiving the reward.
- Booking appointments with no intention of attending (habitual no-shows).
4. Limitation of Liability
To the maximum extent permitted by law, NextEyeExam and its affiliates, directors, or employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service or your visit to a partner clinic. We do not guarantee the quality, safety, or accuracy of the medical services provided by the independent clinics listed on our platform.
5. Privacy and Data Sharing
By submitting a booking request, you explicitly consent to NextEyeExam sharing your name, phone number, email address, and preferred booking times with the specific clinic you selected for the sole purpose of scheduling your appointment.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein.
